1. Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CareVPN ("CareVPN", "we", "our", or "us") governing your access to and use of the website carevpn.top, the Telegram bot @CareVPN_bot, the VPN service, and any related applications, software, content, or services (collectively, the "Service").

By accessing, installing, purchasing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any provision of these Terms, you must immediately discontinue use of the Service.

These Terms apply to all users of the Service regardless of the platform, device, or subscription plan used.

2. Eligibility

By using the Service, you represent and warrant that:

You are at least the age of legal majority in your jurisdiction and have the legal capacity to enter into a binding agreement.

CareVPN reserves the right to refuse access to the Service or suspend an account if these eligibility requirements are not met.

3. Description of the Service

CareVPN provides a Virtual Private Network (VPN) service intended to improve online privacy and security by encrypting Internet traffic transmitted between your device and VPN servers operated or managed by CareVPN.

The Service is designed to help protect your Internet connection while using public or private networks.

CareVPN may introduce new features, modify existing functionality, replace technologies, change server locations, or discontinue specific features whenever reasonably necessary to maintain or improve the Service.

Availability of specific websites, applications, streaming platforms, or other online resources depends on numerous factors outside CareVPN's control, including actions of Internet Service Providers, content providers, governments, and third-party services.

Accordingly, CareVPN does not guarantee that any particular online resource will always be accessible through the Service.

4. Subscription and Payment

Certain features of the Service require an active paid subscription.

Subscription prices, billing periods, and available plans are displayed before purchase through the CareVPN website or Telegram bot.

Access to the Service is granted after successful confirmation of payment.

Unless expressly stated otherwise during the purchase process, subscriptions do not renew automatically.

Users are responsible for ensuring that their payment information is accurate and valid.

Payments are processed through independent third-party payment providers. CareVPN does not collect or store complete payment card information.

Failure to complete payment may result in suspension or expiration of access to the Service.

5. Refund Policy

Because CareVPN provides digital services that become available immediately after purchase, all sales are generally considered final once a subscription has been activated.

Refund requests may be considered only under exceptional circumstances, including:

The purchased subscription could not be activated due to a technical issue solely attributable to CareVPN.
Access to the purchased subscription was never provided.
A duplicate payment was processed.
Another exceptional circumstance exists where CareVPN determines, at its sole discretion, that a refund is appropriate.

To be eligible for consideration, a refund request must be submitted within seven (7) calendar days of the original purchase.

Each request is reviewed individually based on the information provided.

Before initiating a chargeback or payment dispute through a bank or payment provider, users agree to contact CareVPN support and allow a reasonable opportunity to resolve the issue.

Initiating a fraudulent or unjustified chargeback may result in immediate suspension or permanent termination of access to the Service.

6. Acceptable Use

CareVPN is committed to providing a secure, reliable, and privacy-focused VPN service. By using the Service, you agree to use it responsibly and in accordance with all applicable laws and regulations.

You agree that you will not use the Service to:

Violate any applicable law or regulation.
Engage in fraudulent, deceptive, or unlawful activities.
Distribute malware, ransomware, spyware, viruses, or other malicious software.
Gain or attempt to gain unauthorized access to computers, servers, networks, accounts, or data.
Launch, facilitate, or participate in denial-of-service (DoS or DDoS) attacks.
Interfere with the security, stability, or availability of the Service or any third-party systems.
Send unsolicited bulk communications or spam.
Infringe copyrights, trademarks, patents, trade secrets, or other intellectual property rights.
Distribute or transmit content that is unlawful under applicable law.
Use the Service in any manner that could reasonably be expected to damage CareVPN's infrastructure or reputation.

You are solely responsible for your activities while using the Service.

CareVPN does not actively monitor users' Internet traffic. However, where there is a reasonable belief that the Service is being used in violation of these Terms or applicable law, CareVPN may take appropriate measures to protect the integrity and security of the Service, including restricting or terminating access where permitted by law.

7. Availability of the Service

CareVPN makes commercially reasonable efforts to provide reliable and continuous access to the Service.

However, the Service is provided on a best-effort basis, and uninterrupted availability cannot be guaranteed.

Temporary interruptions may occur as a result of:

Scheduled maintenance.
Emergency maintenance.
Infrastructure upgrades.
Hardware or software failures.
Network congestion.
Internet Service Provider issues.
Third-party service interruptions.
Force majeure events or circumstances beyond CareVPN's reasonable control.

CareVPN reserves the right to modify, replace, suspend, or discontinue any part of the Service whenever reasonably necessary to maintain security, stability, or operational efficiency.

Nothing in these Terms shall be interpreted as a guarantee of uninterrupted access, minimum connection speed, or availability of any particular VPN server.

8. No-Logs Policy

Protecting user privacy is one of CareVPN's fundamental principles.

CareVPN is designed to minimize the collection of user information and does not intentionally collect or retain logs of users' online activities while using the VPN Service.

In particular, CareVPN does not intentionally collect or store:

Browsing history.
DNS queries.
Internet traffic content.
Messages transmitted through the VPN.
Files uploaded or downloaded through the VPN.
Information identifying which websites or online services a user has accessed.
Logs capable of linking a user's Internet activity to their account.

To operate the Service securely and efficiently, CareVPN may temporarily process limited technical information that is strictly necessary for purposes such as:

User authentication.
Subscription verification.
Prevention of fraud and abuse.
Protection of the Service against malicious activity.
Diagnosing and resolving technical issues.

Such technical information is processed solely for operational purposes, is not used to monitor users' online activity, and is retained only for as long as reasonably necessary to fulfill those purposes.

Nothing in this section prevents CareVPN from complying with binding legal obligations where disclosure of information is required by applicable law.

9. Intellectual Property

The Service, including its software, website, applications, logos, trademarks, graphics, design elements, documentation, text, and all other content made available through CareVPN, is owned by CareVPN or its licensors and is protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, and revocable right to access and use the Service solely for your personal, lawful, and non-commercial use.

Except as expressly permitted by applicable law, you may not:

Copy, reproduce, or distribute any part of the Service.
Modify, adapt, translate, or create derivative works.
Reverse engineer, decompile, or attempt to discover the source code of any software forming part of the Service.
Sell, sublicense, lease, or commercially exploit the Service.
Remove or alter any copyright, trademark, or proprietary notices.

All rights not expressly granted under these Terms are reserved by CareVPN and its licensors.

10. DMCA / Copyright Complaints

CareVPN provides encrypted VPN connectivity only.

CareVPN does not host, publish, store, control, or monitor the content transmitted through users' Internet connections while using the Service.

If you believe that your intellectual property rights have been infringed in connection with the Service, you may submit a copyright complaint to CareVPN.

A copyright complaint should include:

Identification of the copyrighted work claimed to have been infringed.
A description of the alleged infringement.
Information reasonably sufficient to allow CareVPN to understand and evaluate the complaint.

Due to CareVPN's No-Logs Policy and the encrypted nature of the Service, CareVPN may not possess information capable of identifying individual users or associating Internet activity with a specific account.

Accordingly, CareVPN may be technically unable to investigate certain allegations or take actions requested by complainants.

Nothing in this section shall be interpreted as an admission of liability or an obligation to monitor user activity.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by applicable law, CareVPN expressly disclaims all warranties, representations, and guarantees of any kind, whether express, implied, statutory, or otherwise, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or uninterrupted operation.

CareVPN does not warrant that:

The Service will be available at all times.
Any specific VPN server will remain continuously accessible.
The Service will operate without interruption, delay, or error.
The Service will meet every user's individual requirements or expectations.
Access to third-party websites, applications, or online services will always be available.

Users acknowledge that Internet connectivity depends on numerous third parties beyond CareVPN's control, including Internet Service Providers, telecommunications networks, cloud infrastructure providers, hardware manufacturers, software vendors, and governmental authorities.

12. Limitation of Liability

To the fullest extent permitted by applicable law, CareVPN, its owners, employees, contractors, affiliates, partners, licensors, and suppliers shall not be liable for any direct, indirect, incidental, consequential, exemplary, special, or punitive damages arising out of or relating to the use of, or inability to use, the Service.

This limitation includes, without limitation:

Loss of profits.
Loss of revenue.
Loss of business opportunities.
Loss of goodwill.
Loss of data.
Service interruptions.
Device malfunction.
Security incidents caused by third parties.
Inability to access specific Internet resources.
Government-imposed restrictions.
Any damages resulting from events beyond CareVPN's reasonable control.

Where liability cannot be excluded under applicable law, CareVPN's total aggregate liability shall not exceed the total amount actually paid by the user for the Service during the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not permit certain exclusions or limitations of liability. In such jurisdictions, CareVPN's liability shall be limited only to the maximum extent permitted by applicable law.

13. Suspension and Termination

CareVPN reserves the right to suspend, restrict, or terminate access to the Service, in whole or in part, at any time where reasonably necessary to protect the security, integrity, availability, or lawful operation of the Service.

Access may be suspended or terminated for reasons including, but not limited to:

Where reasonably practicable, CareVPN may provide notice before suspending or terminating access. However, immediate action may be taken where necessary to protect the Service or comply with legal obligations.

Termination of access does not affect any rights or obligations that accrued before termination.

If you do not agree with these Terms, you must immediately discontinue use of the Service.

These Terms represent the entire agreement between you and CareVPN regarding the use of the Service and supersede any prior agreements, communications, or understandings relating to the same subject matter.
